Partner Terms of Service

1. Platform Overview

Deal Punch ("Platform") is operated by MyFit4Challenge, LLC d/b/a Deal Punch. DealPunch is the local business growth platform; our goal is to make deals profitable for everyone — the business, the customer, and the community. The Platform connects local businesses ("Partners") with consumers ("Customers") through discounted QR voucher deals. By submitting a partner application or creating a deal on the Platform, you agree to these terms.

2. Fee Structure

Deal Punch charges a platform fee of 10% of gross sales, capped at $200 per 100 offers sold. The cap resets after each 100-offer block. Partners are also responsible for all payment processing fees (Stripe: 2.9% + $0.30 per transaction). Fees are deducted from sales before payout — there are no upfront costs.

3. Payouts

Partners accumulate a balance as vouchers are sold. Funds become eligible for payout only after the corresponding voucher has been redeemed by the customer. Unredeemed voucher revenue is held until redemption occurs.

Minimum payout: $100. Partners may request a payout through the Partner Portal once their eligible balance reaches $100. Payout requests are reviewed and processed within 5 business days.

Tax information required. Partners must submit a completed W-9 (tax identification) form through the Partner Portal before any payout can be processed. Deal Punch will issue IRS Form 1099-NEC to any partner receiving $600 or more in payouts in a calendar year.

Deal Punch reserves the right to hold payouts if there are unresolved customer disputes, suspected fraud, or outstanding obligations.

4. Deal Obligations

Partners must honor all active vouchers sold through the Platform. Each voucher is valid for 90 days from the date of purchase. Partners may not impose additional conditions, fees, or restrictions not disclosed in the deal listing. Failure to honor vouchers may result in account suspension and refund obligations.

5. Content & Accuracy

Partners are responsible for the accuracy of all deal listings, including pricing, descriptions, and availability. Deal Punch may edit or remove deals that are misleading, inaccurate, or violate these terms. Significant edits proposed by Deal Punch require partner approval.

6. Account Security

Partner account credentials are confidential. Changes to business name, email, or location require Deal Punch approval to prevent identity fraud. Partners are responsible for all activity under their account.

7. Termination

Either party may terminate this agreement at any time. Upon termination, the Partner must honor all outstanding vouchers. Deal Punch will process final payouts within 30 days of termination, less any fees or refund obligations.

8. Limitation of Liability

Deal Punch provides the Platform "as is." We are not liable for: loss of business or revenue, actions of customers, third-party service outages (Stripe, email providers), or any indirect, incidental, or consequential damages. Our total liability is limited to fees collected from the Partner in the preceding 12 months.

9. Governing Law

These terms are governed by the laws of the State of Indiana. Any disputes shall be resolved in the courts of St. Joseph County, Indiana.
